1. Agreement to Terms
By accessing or using the services provided by Boolean & Beyond ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services
Boolean & Beyond provides software engineering, product development, and AI integration services. Our services include but are not limited to:
- Product Engineering with AI
- MVP & Early Product Development
- Generative AI & Agent Systems
- AI Integration for Existing Products
- Technology Modernisation & Migration
- Data Engineering & AI Infrastructure
3. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information required for project delivery
- Respond to queries and provide feedback in a timely manner
- Ensure you have the rights to any materials provided to us
- Make payments according to agreed terms
- Not use our services for any unlawful purpose
4. Intellectual Property
Upon full payment, clients receive ownership of the custom code and deliverables created specifically for their project. We retain ownership of:
- Pre-existing tools, frameworks, and libraries we use
- General knowledge and methodologies
- Any components explicitly identified as proprietary
5. Confidentiality
We maintain strict confidentiality regarding all client information, project details, and proprietary data shared with us. We will not disclose confidential information to third parties without your consent, except as required by law.
6. Payment Terms
Payment terms are specified in individual project agreements. Unless otherwise agreed:
- Invoices are due within 15 days of receipt
- Late payments may incur interest charges
- Work may be paused for overdue payments
7. Limitation of Liability
To the maximum extent permitted by law, Boolean & Beyond shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.
8. Warranty Disclaimer
While we strive to deliver high-quality work, our services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee that our services will meet all your requirements or be error-free.
9. Termination
Either party may terminate the engagement with written notice as specified in the project agreement. Upon termination, you will be responsible for payment of all work completed up to the termination date.
10. Governing Law
These terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka.
11. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be effective upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms.
